A. What Information We Collect

• Account Holder Data: Name, email address, and billing information (securely processed by third-party payment gateways; PIX4BRAIN does not store credit card numbers).

• Emergency Data (End User): Blood type, allergies, medical conditions, medications, and emergency contacts that the user voluntarily decides to enter into the system.

• Interaction Data: Geographic location (IP address) generated only at the exact moment a third party scans the QR code in an emergency situation, for the purpose of notifying linked contacts.

B. Use of Information and HIPAA Compliance

• The exclusive purpose of the Emergency Data is to be displayed in a secure environment when the PIX4BRAIN QR code is scanned by first responders or third parties in the event of an incident.

• Our medical data handling protocols are designed in strict compliance with the privacy standards of the Health Insurance Portability and Accountability Act (HIPAA).

• We do not sell, rent, or trade medical or personal data to third parties, insurance companies, or marketing agencies under any circumstances.

C. Infrastructure, Storage, and Security

• All vital information is hosted on secure cloud servers. We utilize robust relational databases in PostgreSQL, structured in multiple security layers (layered architecture).

• Data is encrypted both in transit and at rest, ensuring that access to medical and user information is impenetrable to unauthorized access and complies with the highest technological and health industry standards.

2. Terms of Service

A. Nature of Service and Logistical Management Mandate

• PIX4BRAIN is a technological platform for data storage and display. We are not a healthcare provider, we do not issue medical diagnoses, and we do not guarantee the intervention of emergency services.

• Logistical Management: For the distribution of hardware (bracelets/devices) and related goods, PIX4BRAIN acts exclusively under a Logistical Management Mandate. We are the designated entity to facilitate secure physical transport, handling, and delivery. We are not the manufacturers or direct sellers of such physical goods.

B. Subscriptions and Payments

• Access to the PIX4BRAIN digital ecosystem operates via a recurring monthly subscription of $4.99 USD, billed through our authorized payment gateway.

• Linked Accounts Program: As an exclusive benefit, certain primary subscriptions grant free access to a "Linked Account" or "Family Account". If the $4.99 USD primary subscription falls into arrears, is canceled, or the payment is declined, the services and access to the PIX4BRAIN digital pass of all accounts linked to said subscriber will be immediately suspended.

C. Border Legal Compliance (Customs and FDA)

• This mandate is executed in strict adherence to federal laws, international trade standards, and border regulations.

• Any device or wellness supply transported under this mandate is strictly for the user's personal use, non-commercial, and in alignment with the FDA (Food and Drug Administration) personal importation policies and CBP (U.S. Customs and Border Protection) regulations.

• It is declared that the physical PIX4BRAIN devices are safe and represent zero safety, environmental, or health risks.

D. Rewards Program (PIX SALDO)

• PIX4BRAIN offers a global affiliate program where users can accumulate PIX SALDO by inviting new active subscribers.

• PIX SALDO has no cash value, is not transferable to bank accounts, and may only be redeemed for in-kind benefits, digital goods (such as telecommunications balance), or products through third-party e-commerce partners affiliated with our program. Any physical delivery resulting from the redemption of PIX SALDO is governed by our Logistical Management Mandate.

E. Electronic Signature & Consent

• The acceptance of these terms at the time of payment, combined with the verified timestamp and the User’s unique originating IP address, constitutes a tacit authorization and a legal electronic signature. This agreement is fully binding and enforceable under the Electronic Signatures in Global and National Commerce Act (ESIGN), the Uniform Electronic Transactions Act (UETA), and relevant international digital commerce laws.

I understand that my digital acceptance, validated by my IP address, constitutes a binding electronic signature under the ESIGN Act. I understand that a recurring charge of $4.99 USD per month will be applied to maintain my protection and that of my linked account active, which I can manage at any time."
